Unfortunately, I am in a situation where both the landlord and myself have signed the contract, which the landlord does not comply with. I am an Erasmus student that came to Lisbon. My boyfriend and I have moved into an apartment that is impossible to live in. The roof is leaking, the humidity problem is huge and the porch is full of feces. Not only that, but when we moved in, everything was dirty and full of somebody's hair and nails.
We have been sending emails back and forth with the landlord and she was aware of the problem, but still did not warn us about it. I have photos and videos of the apartment as proof, and also emails in which she changes her opinion, ignores my questions and threatens that we have to move out in 2 hours (of course - we didn't).
We have paid the rent for a full month, we have paid the deposit and Uniplaces booking fee. As the apartment is unlivable, we have the right to get our money back. However, we did not ask for a full refund. We just asked for our deposit and the landlord said that we will get it back. For whatever reason, she changed her mind and sent the next email saying that she won't give us our deposit back. Uniplaces were also not helpful.
They have so-called 24 hour policy and we did report this problem within 24 hours. However, they said that we can't get out money back. We continued sending emails and then they changed ther mind and said that we would get money back if only we had reported the problem on time.
They obviously thought the apartment is no good as they removed it from their site (without us asking to).
We feel scammed and we still don't know if the landlord will give us our deposit back.
